This Privacy Policy describes the information that Skylark Innovations LLC d.b.a. TrackMyShuttle (“TMS”) and its affiliates collect about you, how we use and protect this information, and the choices you can make about how we use this information. This policy applies to information collected about you by TMS in different methods, including via the Website and via our Products. Some of this information can be used to identify an individual (“Personal Information”). Your privacy matters to us, so please get to know our privacy practices and contact us with any questions at legal@trackmyshuttle.com.

If you are accessing and using the Service on behalf of a company (such as your employer) or other legal entity which is our Client, you represent and warrant that you have the authority to bind that company or other legal entity to these Privacy Policies. References to “you” and “your” in these Privacy Policies refer to that company or other legal entity, our Client.

Definitions

“Account” means the account you create, via our Services, to access your Client Data.

“Apps” means software applications distributed by TMS.

“Client” means the company or legal entity for which you are accepting this agreement, and affiliates of that company or entity.

“Client Data” means data captured by your use of the Hardware, data entered by you into Apps and Web App, and the analysis, reports, alerts, and other derivatives of the data generated by the Products.

“Firmware” means software embedded in or otherwise running on the Hardware.

“Hardware” means the hardware devices such as the tracking modules, tablets, screens, extension cables, adapters, gateways, sensors, and other accessories that you have purchased, received for a free trial, or have otherwise acquired, through TMS.

“Products” means the Hardware, Firmware, Services, and Apps.

“Services” means the Web App and Support that are included with your TMS products.

“Service Order Form” means the original form you used to sign-up for TMS Services. Also referred to as the “Services Agreement”.

“Support” means the customer support services and any additional product training, technical services, product documentation available through our website, or other professional services included in your Services Agreement.

“TMS” means TrackMyShuttle (d.b.a. of Skylark Innovations LLC)

“TOS” means these Terms of Service.

“User(s)” means your customer, the traveler who is either intending to track or request the shuttle.

“Web App” means our web-based software platform, also referred to as the “Portal”.

“Website” means these TrackMyShuttle.com and related pages hosted on the same domain including any third-party application embedded, integrated or used to generate and nurture leads and to support potential and existing customers. This also includes the Web App.

1. COLLECTION AND USE OF PERSONAL INFORMATION

TMS may collect information about you from a variety of sources. We may collect information about you that you provide directly, through our Website, use of our Products and Services, or via third-party integrations.

We use the information to create orders for you; deliver products and services; process payments; or communicate with you regarding your orders, our products, and our services, including promotional offers and suggested products, services or new features which may be of interest to you.

We use the information we collect from all our products and services to provide, maintain, and improve them; to develop new products; and to protect TMS and our users. When you contact TMS, we may keep a record of your communication to better support you in the future.

From time to time, we may offer referral programs enabling our users to refer prospective customers to us. Please only refer a prospective customer and provide their personal information to us if you have their permission. If you later find out you did not have such consent, please inform us as soon as possible.

Information from our Website

You provide information to us when you visit our website, such as your internet protocol address, computer and connection information, browser information, cookie information, session information, location, and other technical information related to your visit.

You also provide us information when you place an order, create an account in our hosted software, communicate with us via our Website, complete a survey, request a demonstration, request email updates, etc. You may supply us information, such as your name, address, phone number, email address, business name, job title, credit card information, and other financial information. You may also supply us with the same information about your personnel.

Information from our Products and Services

Our Products and Services are designed for use by our Clients to monitor their vehicles, drivers, share vehicle location information with their customers, our Users, and other aspects of their operations. To this end, our products collect data through a variety of means. For example, data entered by you into our hosted software and mobile apps, entered by Users into our mobile and Web Apps, and captured by other capabilities in our products or third party products that integrate with our products.

  • Driver information, such as driver name, phone number, email address, location, routes taken, driving behavior, or hours of service
  • Client personnel information, such as name, phone number, or email address of your personnel
  • User information, such as name, phone number, location, pick-up or drop-off information

The accuracy of the any Personal Information of your personnel, drivers or Users as entered by you is your responsibility.

2. COLLECTION AND USE OF NON-PERSONAL INFORMATION

Non-Personal Information collected by sensors built into our hardware devices that you install in your vehicles and assets includes Vehicle Identification Number (VIN), make, model, location, speed, engine faults, fuel level, etc.

TMS may automatically collect non-Personal Information relating to such matters as the total number of visits to our Website, the number of visitors to each page of our Website, the Internet Protocol address of our visitors, and the time spent on our Website. We may also automatically collect non-Personal Information from your use of our Products and Services such as the number of Portal logins, the usage of Portal features, the number of App views by your personnel and Users. We may use this information, which is collected in and remains in aggregate form, to understand how our visitors use this website so that we can improve it. From time to time, we may share aggregated, non-Personal Information with our agents, business partners, consultants or other third parties.

We may share aggregated or anonymized data collected by our products for purposes, such as analytics, education or marketing, provided that the data cannot reasonably be used to identify any individual or organization.

Cookies and Web Beacons

Some non-Personal Information may be collected through cookies. Cookies, used by most websites, are text files stored on a user’s browser containing information about the user. We use cookies for several purposes including to track the interests of our users, to enhance their experience on our Website, Portal and Apps, and to deliver content specific to a user’s interests. We also use cookies to identify popular sections, to recognize how frequently you have visited, to remember your preferences on our Website, Portal and Apps and to improve the security of our Products and Services.

Our Website cannot be accessed without the use of cookies. Before using our Website, you will be asked to acknowledge the use of cookies – if you do not wish to receive cookies from our Website, please do not visit our Website. You can delete cookies at any time using the tools in your web browser.

Some third-party service providers that we engage with (including third-party advertisers) may also place their own cookies on your browser. Note that this Privacy Policy covers only our use of cookies and does not include use of cookies by such third parties.

3. DISCLOSURE OF PERSONAL INFORMATION

User’s Personal Information either entered by the User, obtained from third-party integrations or entered directly by you may be stored for a reasonable amount of time required to complete the operation (the “Operation”) before being purged. The Operation starts when the original request for reservation or booking is made, lasts through the time in journey and concludes after a reasonable amount of time has passed to aid potential dispute resolution.

We will only share Personal Information with companies, organizations or individuals outside of TMS when we have your consent to do so, other than as provided herein.

Personal Information may be disclosed in limited circumstances, including, but not limited to meeting any applicable law, regulation, legal process, or enforceable governmental request; the investigation of potential violations; addressing fraud, security, or technical issues; to protect and defend the rights or property of TMS; or in an emergency threatening an individual’s life, health, or security.

We reserve the right to disclose your Personal Information as required by law or when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process.

We rely on third-party service providers to perform a variety of services on our behalf. In so doing, we may need to share your Personal Information with them. We provide our service providers with only the Personal Information they need to perform their services and we require that they protect this information and not use it for any other purpose. We may supplement your Personal Information with information from third parties.

Some of our Products and Services may be offered jointly with partners. If you register with our partner, TMS may also receive your Personal Information from them, and TMS may share your Personal Information with our partners for these joint offerings. You should also review the partner’s privacy policy, which may have different terms.

Information that we collect from our users, including Personal Information, is considered to be a business asset. Thus, if we are acquired by a third-party as a result of a transaction, such as a merger, acquisition, or asset sale, some or all of our assets, including your Personal Information, may be disclosed or transferred to a third-party acquirer in connection with the transaction.

We will maintain reasonable administrative, physical, and technical safeguards for protection of the security, confidentiality and integrity of your Client Data. You may export your Client Data at any time via a written request. While we aim to make as much of your Client Data as possible available for export, you acknowledge that some information may not be exportable. Please contact Support for information on how long your Client Data will be stored by us. If your agreement with TMS terminates or expires and you do not renew, your Client Data may be immediately deleted. You acknowledge that not all Client Data is intended for long-term storage. Contact TMS support if you have questions about what data is being stored.

Information Transfer

Your Personal Information may be transferred to, stored in, and processed in a country other than the one in which it was provided.

4. SECURITY

We are committed to keeping Personal Information secure, and have implemented generally accepted industry standards of technical, administrative, and physical procedures to protect Personal Information. When we provide your Personal Information to controllers or processors, including service providers, we require those companies to protect the information and not use the information for any other purpose.

Nevertheless, although we have tried to create secure and reliable Website and Products, the confidentiality of any communication or material transmitted to or from our Website or Products cannot be guaranteed. We urge you to exercise caution when conveying Personal Information over the internet. When disclosing any Personal Information, you should remain mindful that such information might be accessible by the public and, consequently, may be collected and used by others without your consent. You should also recognize that your use of the internet, our Website, Products and Services is solely at your own risk.

5. THIRD-PARTY WEBSITES AND FEATURES ON TRACKMYSHUTTLE.com

As a convenience to you, TMS may provide links from the Website to other websites maintained by independent third parties. We are not responsible for the privacy practices of independent third parties. We encourage you to be aware when you leave our Website, and to read the privacy policies of any other websites that you may visit.

6. MINOR POLICY

Our products are not directed to minors under 16 and we do not knowingly collect Personal Information from minors under 16. If we learn that we have collected Personal Information of a minor under 16 we will take steps to delete such information from our files as soon as possible.

7. DATA PROTECTION AND REVOCATION RIGHTS

You may delete Client Data by contacting support. You have the right to access, update, and delete your Client Data or withdraw your consent to use your Client Data at any time. Please email legal@trackmyshuttle.com, and we will respond to your request within one month or less. Please note that withdrawing consent or choosing to delete your Client Data may prevent us from supplying products and/or services to you.

8. CHANGES

Our Privacy Policy may change from time to time. We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review.
